Service Terms
Version 2026-11-06. Effective November 6, 2026.
These Service Terms apply to every service Coastal Home Management 30A, LLC ("CHM", "we", "us") provides to you ("Client", "you"): recurring plans, one-time visits, storm prep and after-storm checks, freeze checks, deliveries and let-ins, installations, vendor and cleaning coordination, and any other job.
The details of each job (the property, the services, the price and any term) are set out in a Service Order. A Service Order can be an invoice, a quote, a written proposal, a booking in our homeowner portal, or a written message from us describing the job. These Service Terms and each Service Order together are the agreement between you and CHM.
1. How you accept
You accept these Service Terms by any of the following: (a) signing them on paper or electronically; (b) checking a box or clicking to accept in our portal or on a form; (c) replying "yes", "approved" or similar by text or email to a Service Order or to a message that links these terms; (d) paying any CHM invoice; or (e) allowing us to perform services after these terms have been provided or linked to you.
Your acceptance covers every Service Order from then on until these terms are replaced under section 13.2.
2. Our services
2.1 Scope. We perform the services described in the Service Order. Anything not in the Service Order is extra and is billed at our current rates once you approve it.
2.2 Visual checks only. Visits are visual, non-invasive checks of readily accessible areas. Unless the Service Order says otherwise, we do not move furniture or belongings, open walls, ceilings or equipment, go on roofs, enter attics or crawl spaces, or test systems beyond what is described.
2.3 What we are not. CHM is not a licensed home inspector, contractor, plumber, electrician, HVAC contractor, pest control operator, insurance agent or adjuster, real estate broker, security company or alarm monitoring company. Our visits are not home inspections, appraisals, code reviews, insurance evaluations or security monitoring.
2.4 No guarantee. Our services reduce the chance that a problem goes unnoticed for a long time. We do not guarantee that any problem will be found, prevented or stopped, and we do not watch the property between visits.
2.5 Reports. We send photos and notes about what we observed. A report reflects only the conditions we observed during that visit.
2.6 Scheduling. We may move a visit for weather, safety, holidays or scheduling. We will make up a missed recurring visit when reasonably possible.
2.7 Who performs the work. Services may be performed by CHM's owner, employees or independent contractors working for CHM.
3. Your responsibilities
3.1 Insurance. Keep the property insured at all times with homeowners coverage, and flood and wind coverage where appropriate. CHM's services are not a substitute for insurance.
3.2 Condition. Maintain the property and its systems in safe working condition, and tell us about known problems, hazards, alarms, pets, firearms or restricted areas.
3.3 Access. Give us working keys, codes, gate access and alarm instructions, and keep them current.
3.4 Who is there. Tell us about arrivals, departures, guests, vendors and anyone else who uses or has access to the property.
3.5 Utilities. Keep utilities on unless you tell us otherwise in writing.
3.6 Decisions and repairs. Respond to our reports and requests within a reasonable time. Repairs, maintenance and decisions about the property remain your responsibility.
4. Keys, codes and access
We keep keys and codes secure, use them only to provide services, and limit them to people performing services for CHM. Codes are stored encrypted. When services end, we return your keys or confirm they were destroyed, and you should change your codes.
We are not responsible for loss caused by others who have their own access to the property, such as owners, guests, renters, rental managers, vendors, HOAs or utilities.
5. Urgent conditions, storms and vendors
5.1 Urgent conditions. If we see an urgent condition (for example active water, loss of power, or an open entry), we will try to reach you. If we cannot reach you within a reasonable time, you authorize us to take reasonable steps to limit damage, such as shutting off water or power, and to call a qualified vendor, up to $500 per incident without further approval. You pay the vendor's charges and our time at our current rates.
5.2 Storms. We are not on call during a hurricane, tropical storm, evacuation order or other unsafe condition. Storm services are performed only when it is safe and lawful, and storm preparation reduces but does not prevent storm damage.
5.3 Vendors are independent. Plumbers, HVAC companies, cleaners, contractors and other vendors are independent businesses, not CHM. Their work is between you and them, even when we schedule, meet, let in or check on them. CHM is not responsible for their work, delays, pricing, damage or failures.
5.4 Coordinated services. When we arrange a service through a vendor and bill you for it, we bill at CHM's rates. CHM's rates include our coordination, scheduling and oversight and may be more than the vendor charges us.
6. Fees and payment
6.1 Prices, billing dates and any term are as stated in each Service Order.
6.2 Invoices are due on receipt unless the Service Order says otherwise.
6.3 Payment method. Bank transfer (ACH) payments have no added fee. Credit card payments include a card processing fee, currently 2.6%, which never exceeds CHM's cost of card acceptance. Debit cards are not accepted.
6.4 Late payment. If a balance is more than 15 days late, we may pause services and charge a late fee of 1.5% per month, or the highest rate allowed by law if that is lower.
6.5 Collection. You pay the reasonable costs of collecting unpaid amounts, including attorney's fees as provided in section 11.
7. Term and cancellation
7.1 Term plans. A recurring plan with a term (for example 6 or 12 months) runs for that term and is billed monthly at the locked rate for the whole term, whether or not you are in town.
7.2 No automatic new term. A term plan does not renew into a new term on its own. When the term ends, service continues month to month at our then current rates until either of us cancels with 30 days written notice, unless you agree to a new term.
7.3 Ending a term early. If you end a term plan early, you owe the early cancellation fee in the Service Order. If none is stated, the fee is the lesser of $150 or the fees remaining in the term.
7.4 Month to month. Month-to-month service may be cancelled by either of us with 30 days written notice.
7.5 Ending immediately. We may end services immediately if you do not pay, if the property is unsafe, or if we are asked to do something unlawful or unsafe.
7.6 One-time jobs. Cancel at least 72 hours before the scheduled time for a full refund of anything paid for that job.
8. Limitation of liability
8.1 To the fullest extent allowed by law, CHM is not liable for: (a) loss or damage that happens between visits or that CHM did not cause; (b) conditions that were hidden, inaccessible, pre-existing or outside the scope of the Service Order; (c) acts or omissions of vendors, guests, renters, other occupants, HOAs, utilities or other third parties; (d) weather, storms, flooding, fire, freezing, mold, pests, power or utility failures, equipment failure, or other events outside our reasonable control; or (e) indirect, incidental, consequential, special or punitive damages, including loss of use or rental income.
8.2 CHM's total liability for any claim arising from the services or this agreement is limited to the fees you paid CHM for the services giving rise to the claim during the 3 months before the claim, or, for a one-time job, the price of that job.
8.3 This section does not limit any liability that Florida law does not allow to be limited, such as liability for intentional misconduct.
9. Your insurance comes first
You will look first to your own property insurance for any loss to the property or its contents. To the extent your policies allow, you waive, and will ask your insurers to waive, any right of recovery against CHM for losses covered by your insurance (a waiver of subrogation).
CHM carries general liability insurance and will provide a certificate on request. CHM does not give advice about your insurance coverage.
10. Indemnity
You will indemnify and hold harmless CHM, its owner, employees and contractors from claims, losses and costs, including reasonable attorney's fees, brought by third parties (such as guests, renters, vendors or insurers) that arise from the property, its condition, or your instructions, except to the extent caused by CHM's gross negligence or intentional misconduct.
11. Disputes
11.1 Florida law governs this agreement.
11.2 Venue is the state courts of Walton County, Florida, including small claims court where available.
11.3 Before filing a lawsuit, the party with a complaint will give the other written notice describing it and 30 days to try to resolve it.
11.4 The prevailing party in any lawsuit about this agreement or the services recovers reasonable attorney's fees and costs.
11.5 JURY WAIVER. YOU AND CHM EACH KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A JURY TRIAL IN ANY DISPUTE ARISING FROM THIS AGREEMENT OR THE SERVICES.
12. Photos, records and communications
12.1 We take photos and notes of the property to provide services and keep records. We do not publish interior photos or anything that identifies your property without your permission.
12.2 You agree that we may contact you about your property and our services by phone, text and email at the contact details you give us. Message and data rates may apply. Reply STOP to stop texts at any time.
12.3 Our Privacy Policy at coastalhomemngt30a.com/privacy-policy explains how we handle information.
13. General
13.1 Whole agreement. These Service Terms, each Service Order, and any signed agreement made specifically for you are the whole agreement. If a signed agreement made specifically for you conflicts with these terms, that signed agreement controls. A Service Order controls over these terms only for price, schedule, term and the description of services.
13.2 Updates. We may update these terms by posting a new version at coastalhomemngt30a.com/service-terms and emailing you at least 30 days before it takes effect. If you keep receiving or paying for services after that date, you accept the update. An update never changes a locked price or term you already have.
13.3 Assignment. CHM may assign this agreement to a business that takes over CHM's services and will tell you if it does. You may not assign it without our written consent.
13.4 Independent business. CHM is an independent contractor. This agreement does not create a partnership, employment or agency relationship, except for the limited authority in section 5.1.
13.5 Severability. If any part of this agreement is unenforceable, the rest stays in effect and that part is enforced as far as the law allows.
13.6 Notices. Written notice may be given by email to the address each of us uses with the other. CHM: coastalhomemanagement30a@gmail.com, 41 Windrow Way, Inlet Beach, FL 32461, (309) 415-8793.
13.7 Electronic records. Electronic records, acceptances and signatures have the same effect as paper originals.
